Privacy Policy

This privacy policy informs you about the nature, scope and purpose of the processing of personal data on this website in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

1. Controller

The controller responsible for data processing on this website is:

Alexander Zylla
Klapperstraße 57
45277 Essen
Germany
Email: support@apezaudio.com

2. Hosting

This website is hosted by an external service provider (processor): [Hosting provider – company name and address]. The hosting provider processes personal data transmitted via this website (e.g. IP addresses, requests) on our behalf and exclusively in accordance with our instructions. The legal basis is our legitimate interest in the secure and efficient provision of our website (Art. 6 (1) (f) GDPR). We have concluded a data processing agreement (Auftragsverarbeitungsvertrag, Art. 28 GDPR) with the hosting provider.

3. Server log files

When you visit the website, the hosting provider automatically collects and stores information in server log files that your browser transmits. This includes: browser type and version, operating system, referrer URL, host name of the accessing computer, time of the server request and IP address. This data is not merged with other data sources. Processing is based on Art. 6 (1) (f) GDPR (legitimate interest in the technically error-free presentation and security of the website).

4. Cookies

This website uses cookies. Cookies are small text files stored on your device. We use technically necessary cookies that are required for the operation of the shop (e.g. session cookies, the shopping cart and the login of your customer account, set by WordPress and WooCommerce). These are based on Art. 6 (1) (f) GDPR. We do not use tracking, advertising or analytics cookies. You can configure your browser to refuse cookies; in that case some functions of the shop may not work.

5. Customer account and orders (WooCommerce)

If you create a customer account or place an order, we process the data you provide (e.g. name, billing and shipping address, email address) in order to establish and manage the account and to process the order. Processing is based on Art. 6 (1) (b) GDPR (performance of a contract or pre-contractual measures). Order and account data is stored until the account is deleted, unless statutory retention periods (e.g. under commercial and tax law) require longer storage.

6. Downloads

Our products are provided as digital downloads. In order to make downloads available and prevent misuse, we process the associated account/order data and download logs on the basis of Art. 6 (1) (b) GDPR.

7. Newsletter

If you sign up for our newsletter, we store the email address you provide in order to send you information about products and news. This is done exclusively on the basis of your consent (Art. 6 (1) (a) GDPR). The email addresses are stored on our own system; they are not passed on to third parties. You can withdraw your consent and unsubscribe at any time, for example by sending a message to support@apezaudio.com. The withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

8. Product reviews

If you submit a product review, we process the content of the review together with the name and, where applicable, the email address you provide. This is based on Art. 6 (1) (a) and (f) GDPR (consent / legitimate interest in transparent product feedback).

9. Contact by email

If you contact us by email, the information you provide will be processed for the purpose of handling your enquiry (Art. 6 (1) (b) and (f) GDPR). We delete this data once it is no longer required, unless statutory retention periods apply.

10. Payment (Mollie)

If you purchase a paid product, the payment data required to process the transaction is processed in order to perform the contract (Art. 6 (1) (b) GDPR). Payments are handled by our payment service provider Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands. When you pay, the data required for the transaction (e.g. the details entered for the selected payment method) is transmitted to Mollie, which processes it under its own responsibility as an independent controller in accordance with its privacy policy (see https://www.mollie.com/privacy). We receive from Mollie only the information required to confirm and fulfil the order (e.g. payment status); we do not store full card or bank details ourselves. Products offered free of charge do not involve any payment data.

11. Your rights

You have the right, within the limits of the law, to: information about your stored data (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing (Art. 21). Where processing is based on consent, you may withdraw that consent at any time with effect for the future. To exercise your rights, please contact support@apezaudio.com.

12. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen).

13. Changes to this privacy policy

We reserve the right to amend this privacy policy so that it always complies with current legal requirements or to implement changes to our services. The current version applies to your next visit.
